These Terms apply to consumers purchasing goods for personal use.
2. Scope and Acceptance
By placing an order, the customer:
- Agrees to be legally bound by these Terms;
- Confirms they are at least 18 years old;
- Confirms the information provided is accurate.
We reserve the right to refuse service at our sole discretion.
3. Products – Natural Materials Disclaimer
All products are made from natural stone materials.
The customer acknowledges and agrees that variations in:
- Color
- Veining
- Texture
- Pattern
- Finish
Are:
- Inherent characteristics of natural materials;
- Not defects;
- Not grounds for return, refund, or dispute.
All images, samples, and descriptions are illustrative only.
4. Orders and Acceptance
All orders are subject to acceptance.
We may:
- Refuse or cancel orders at any time;
- Cancel orders due to pricing errors, fraud suspicion, or stock issues.
A contract is formed only when the order is explicitly confirmed or goods are dispatched.
5. Pricing, Taxes, and Duties
All prices are in EUR.
For international customers (including USA and UK):
- Prices do not include import duties, VAT, sales tax, or customs fees;
- The customer is the importer of record;
- All taxes, duties, and compliance obligations are the customer's responsibility.
We are not responsible for:
- Customs delays;
- Additional charges;
- Refused imports.
6. Payment and Fraud Protection
Payment is required in full at checkout.
We reserve the right to:
- Delay or cancel orders for verification;
- Request additional identification;
- Refuse high-risk transactions.
We are not liable for:
- Payment processor errors;
- Unauthorized use of payment methods (handled by provider).
7. Shipping, Delivery, and Risk Transfer
Delivery dates are estimates only.
Risk transfers to the customer upon handover to the carrier or logistics provider.
We are not liable for:
- Loss, theft, or damage in transit;
- Carrier delays or failures.
Claims for shipping damage must be made directly with the carrier where applicable.
8. Right of Withdrawal (EU/UK Consumers Only)
Where applicable under law, customers may withdraw within 14 days of delivery.
Conditions:
- Goods must be unused and in original condition;
- Return shipping costs are borne by the customer.
For non-EU customers (including USA) returns are accepted only at our sole discretion.
9. Non-Returnable Items
The following are strictly non-returnable:
- Custom-made or made-to-order products;
- Products cut, modified, or installed;
- Products exhibiting natural variation.
10. Returns and Remedies
If a product is confirmed defective, we may, at our sole discretion:
- Replace;
- Repair;
- Refund.
No other remedies are available.
11. Disclaimer of Warranties (IMPORTANT – USA/UK)
To the fullest extent permitted by law:
All products are provided “as is” and “as available”.
We expressly disclaim:
- Any implied warranties
- Merchantability
- Fitness for a particular purpose
- Non-infringement
Nothing in these Terms excludes rights that cannot be excluded under applicable consumer law.
12. Limitation of Liability
To the maximum extent permitted by law:
We shall not be liable for:
- Indirect or consequential damages;
- Loss of profit, revenue, or business;
- Delays or failure of performance.
Total liability is strictly limited to the amount paid for the product.
13. Force Majeure
We are not liable for failure or delay due to:
- Natural disasters
- Pandemics
- War
- Strikes
- Logistics disruptions
- Supplier failure
Obligations are suspended during such events.
14. Intellectual Property
All content remains our exclusive property.
No use, reproduction, or distribution is permitted without written consent.
15. Compliance and Import Responsibility
The customer is solely responsible for:
- Compliance with local laws;
- Import regulations;
- Product suitability in destination country.
We make no guarantees that products meet regulations outside Portugal.
16. Chargebacks and Disputes
Customers agree to:
- Contact us before initiating any chargeback;
- Provide opportunity to resolve disputes.
Unjustified chargebacks may result in:
- Legal action;
- Recovery of costs and fees.
17. Governing Law and Jurisdiction
These Terms are governed by the laws of Portugal.
Where legally permissible disputes shall be subject to the exclusive jurisdiction of Portuguese courts.
We reserve the right to initiate proceedings in the customer's country of residence.
18. Severability
If any provision is found invalid, the remaining provisions remain fully enforceable.
19. Waiver
Failure to enforce any right shall not constitute a waiver.
20. Entire Agreement
These Terms constitute the entire agreement between the parties.
21. Changes to Terms
We may update these Terms at any time.
Continued use of the website constitutes acceptance of the updated Terms.
