These Terms and Conditions govern all sales made through this website operated by:

These Terms apply primarily to business customers (B2B transactions).

By placing an order, the customer confirms that they are acting in the course of trade, business, or profession.

2. Scope and Acceptance

These Terms apply to all offers, quotations, and sales contracts unless otherwise agreed in writing.

Any conflicting terms from the customer are expressly rejected unless accepted in writing.

3. Products – Natural Materials Disclaimer

All products are made from natural stone materials.

The customer acknowledges and agrees that variations in:

  • Color
  • Veining
  • Texture
  • Pattern
  • Finish

Are:

  • Inherent characteristics of natural materials;
  • Not defects;
  • Not grounds for return, refund, or dispute.

All images, samples, and descriptions are illustrative only.

4. Quotations and Orders

All quotations:

  • Are non-binding;
  • Valid for 30 days, unless stated otherwise.

A contract is only formed when the order is confirmed in writing, or the goods are dispatched

We reserve the right to:

  • Refuse or cancel any order;
  • Limit quantities.

5. Pricing and Taxes

All prices are in EUR unless otherwise stated.

Unless explicitly agreed otherwise:

  • Prices are EXW (Ex Works – Portugal, Incoterms® 2020)
  • Prices exclude: VAT, transport, insurance, customs duties, import taxes.

All such costs are borne by the customer.

6. Payment Terms

Unless otherwise agreed:

  • 100% prepayment is required before dispatch.

Accepted methods:

  • Bank transfer;
  • PayPal;
  • Credit/debit card.

Late payments may result in:

  • Suspension of deliveries;
  • Interest charges (in accordance with applicable law).

Ownership of goods remains with us until full payment is received.

7. Delivery and Transfer of Risk

Delivery terms follow Incoterms® 2020 (EXW) unless otherwise agreed.

Risk transfers to the customer at the moment goods are made available for collection or handed to the carrier.

Delivery times:

  • Are estimates only
  • Not legally binding

We are not liable for delays caused by:

  • Carriers
  • Customs
  • Force majeure

8. Inspection and Claims

The customer must inspect goods immediately upon receipt.

Any claims must be made:

  • Within 5 business days of delivery;
  • In writing;
  • With supporting evidence (photos, reports).

Failure to notify within this period constitutes acceptance of the goods.

9. Returns and Refunds

Returns are only accepted if:

  • Goods are defective, or;
  • Goods do not conform materially to agreed specifications.

Returns require:

  • Prior written authorization;
  • Documented evidence.

Retunrs not accepted:

  • Natural stone variations;
  • Custom-made products;
  • Incorrect handling or installation.

Approved returns:

  • May result in replacement, repair, or refund (at our discretion).

10. Custom and Made-to-Order Products

Products manufactured according to customer specifications:

  • Are non-cancellable after production begins;
  • Are non-returnable;
  • Require full payment in advance.

The customer is solely responsible for:

  • Measurements;
  • Specifications;
  • Technical drawings approval.

11. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for:

  • Indirect damages;
  • Loss of profit;
  • Business interruption;
  • Loss of contracts or opportunities.

Total liability is limited to the value of the goods supplied.

12. Force Majeure

We are not liable for failure or delay due to:

  • Natural disasters
  • Pandemics
  • War
  • Strikes
  • Logistics disruptions
  • Supplier failure

Obligations are suspended during such events.

13. Intellectual Property

All content remains our exclusive property.

No use, reproduction, or distribution is permitted without written consent.

14. Compliance and Import Responsibility

The customer is responsible for:

  • Compliance with local laws;
  • Import regulations;
  • Customs clearance;
  • Certifications required in destination country.

We are not liable for:

  • Customs delays;
  • Import refusals.

15. Shopify / Online Sales Specific Terms

For orders placed via ecommerce platforms (including Shopify):

  • Orders are subject to manual review and confirmation
  • Shipping costs may be calculated after checkout
  • We reserve the right to adjust pricing due to logistics and cancel orders with pricing or stock errors.

Payment does not guarantee acceptance of the order.

16. Governing Law and Jurisdiction

These Terms are governed by the laws of Portugal.

For B2B transactions, all disputes shall be subject to the exclusive jurisdiction of Portuguese courts.

17. Dispute Resolution (EU Optional)

For EU-based customers, dispute resolution may be available via:

18. Changes to Terms

We may update these Terms at any time.
